Notes

  • Federal minimum age of sale for all retailers in every state. A state may set a higher age; some state statutes still state a lower age, which the federal rule overrides for retail sales.
  • The federal definition of tobacco product covers any product containing nicotine from any source, which includes e-cigarettes and e-liquids.
  • Nicotine pouches are not named; as products containing nicotine they are tobacco products for federal purposes and cannot be sold to anyone under 21. FDA marketing authorisation is a separate matter and is not covered here.
  • Federal law does not set a general smoking ban for indoor public places; smoke-free rules are set by states and local governments. Some federal rules apply only to federal facilities, aircraft or specific premises.
  • Federal rule for flights of air carriers, including e-cigarettes. It does not cover buses, trains or other public transport, which are left to states and local governments.
