Tobacco and nicotine age limits in North Carolina (2026)

Last reviewed: 9 October 2026

In short: Federal rules bar retailers from selling tobacco products, including e-cigarettes and nicotine pouches, to anyone under 21 in North Carolina. The state's smoking law covers only lighted tobacco products, so it does not apply to e-cigarettes.

Notes

  • The state statute on the sale age could not be read, so this is the federal retail rule, which applies in every state. The state law may set the same or a higher age.
  • Federal rule for covered tobacco products, which include e-cigarettes. The state statute could not be read.
  • The state smoke-free statutes could not be read. The North Carolina General Assembly's site (ncleg.gov) refused access (HTTP 403).
  • Nicotine pouches are not named in the federal text. Under federal law any product containing nicotine from any source is a tobacco product that retailers may not sell to anyone under 21; the state's own statute was not checked for this rule.
  • The official site (ncleg.gov) refused automated requests, so the text was read from an Internet Archive snapshot. Local rules and the policies of individual businesses may still prohibit vaping.
