Tobacco and nicotine age limits in Texas (2026)

Last reviewed: 9 October 2026

In short: Texas law prohibits giving or selling cigarettes, e-cigarettes and tobacco products to anyone younger than 21, with an exception for 18-year-olds with military identification; federal law sets 21 for nicotine pouches. The state offence of smoking or using an e-cigarette covers listed places, including buses, planes and trains, rather than all indoor public places.

Notes

  • There is an exception for a person at least 18 who presents a valid United States or state military identification card (§ 161.082(f)). Covers cigarettes, e-cigarettes and tobacco products.
  • Same military-identification exception as for tobacco (§ 161.082(f)).
  • The state offence applies only to the listed facilities and conveyances; it is not a general ban in all indoor public places. Local ordinances may differ.
  • Smoking is allowed in an area designated for smoking (§ 48.01(d)). The offence also covers operating an e-cigarette.
  • Nicotine pouches are not named in the federal text. Under federal law any product containing nicotine from any source is a tobacco product that retailers may not sell to anyone under 21; the state's own statute was not checked for this rule.
