Notes
- Possession, purchase or consumption by a person under 21 is also unlawful (§ 34-46-2(2)). From 1 January 2027 section 34-46-2 is replaced by a version referring to "nicotine products" as defined in § 10-50E-1 (SL 2026, ch 54); the age stays 21.
- Exceptions include posted hotel smoking rooms, certain licensed establishments where alcohol is sold, and certain retail tobacco stores (§§ 34-46-17 to 34-46-19). Vapor products count as tobacco products under § 34-46-20.
- The smoke-free provisions apply to enclosed public places and places of employment (§§ 34-46-13 and 34-46-14) and do not mention public transport vehicles, so the position for buses and trains was not confirmed.
- Nicotine pouches are not named in the federal text. Under federal law any product containing nicotine from any source is a tobacco product that retailers may not sell to anyone under 21; the state's own statute was not checked for this rule.
