Notes

  • The Department of Health states that since 1 November 2017 the sale of tobacco products to anyone under 21 is prohibited. The statute itself (N.J.S.A. 2A:170-51.4 and 54:40A-4.1) could not be opened.
  • Federal rule for covered tobacco products, which include e-cigarettes. The New Jersey statute text could not be opened, so the state rule on electronic smoking devices is not confirmed here.
  • The text read is the 2009 amending act as published by the Department of Health. Exceptions include casino gaming areas, registered cigar bars and lounges, tobacco retail establishments and up to 20% of hotel guest rooms.
  • The definition of 'indoor public place' includes any public conveyance operated on land, water or in the air and passenger waiting rooms and platform areas in stations and terminals.
  • Nicotine pouches are not named in the federal text. Under federal law any product containing nicotine from any source is a tobacco product that retailers may not sell to anyone under 21; the state's own statute was not checked for this rule.
  • The bill number and signing date come from the Governor's press release of 21 January 2020, linked from the Department of Health page. The statute text itself could not be read because the Legislature's site did not respond.
