In short: Oregon law makes it an offence to sell tobacco products or inhalant delivery systems such as e-cigarettes to anyone under 21, and federal law sets 21 for nicotine pouches. The Indoor Clean Air Act prohibits smoking, aerosolising or vaporising in enclosed public places and places of employment. Smoking or vaping in a car with anyone under 18 is a traffic violation.

Notes

  • Tobacco products are defined in ORS 431A.175(1)(b).
  • Exceptions are set out in ORS 433.850 (for example smoke shops and cigar bars). Smoking within 10 feet of entrances, exits, opening windows and ventilation intakes is also prohibited (ORS 433.845(2)).
  • The Indoor Clean Air Act applies to enclosed areas open to the public and places of employment (ORS 433.835 and 433.845); public transport vehicles are not named in the sections read, so coverage was not confirmed.
  • Nicotine pouches are not named in the federal text. Under federal law any product containing nicotine from any source is a tobacco product that retailers may not sell to anyone under 21; the state's own statute was not checked for this rule.
