Tobacco and nicotine age limits in Missouri (2026)

Last reviewed: 9 October 2026

In short: Missouri's own statute sets the sale age for tobacco, alternative nicotine and vapor products at 18, but the federal retail rule bars sales to anyone under 21. Smoking in public places is allowed in designated smoking areas of up to 30% of the space. The state law does not cover e-cigarettes.

Notes

  • RSMo 407.926 sets 18 as the state sale age for tobacco, alternative nicotine and vapor products. The federal rule in 21 CFR 1140.14 prohibits retailers from selling to under-21s, so 21 is the effective age.
  • RSMo 407.926 age-limits alternative nicotine products (non-combustible nicotine products that are absorbed or dissolved) at 18. Nicotine pouches are not named; the federal age is 21.
  • RSMo 191.775 bans smoking and vapor use on school buses and in public school buildings. RSMo 191.769 lets taxis and limousines for hire allow smoking if all agree. No general public transport ban was read.
  • The Missouri Indoor Clean Air Act prohibits smoking in public places and public meetings except in designated smoking areas, which may cover up to 30% of a public place.
  • Local rules and the policies of individual businesses may still prohibit vaping.
