Notes

  • Federal law separately prohibits retailers from selling cigarettes and smokeless tobacco to anyone younger than 21 (21 CFR 1140.14(a)(1)); the Wisconsin statute read still states 18.
  • The statute covers products that contain nicotine; the state statute read states 18, while a federal retailer rule sets 21 for cigarettes and smokeless tobacco.
  • Nicotine pouches are not named; the definition covers any nicotine-containing product other than tobacco products, cigarettes and FDA-approved cessation or medical products.
  • Smoking is defined (§ 101.123(1)(h)) as burning or holding or inhaling smoke from lighted tobacco-containing items such as cigars, cigarettes and pipes. Exceptions are in § 101.123(3).
  • Section 101.123 defines "public conveyance" but the prohibitions read in sub. (2) list places such as restaurants, retail establishments and public places; a specific ban on smoking in public transport vehicles was not confirmed.
  • Local rules and the policies of individual businesses may still prohibit vaping. Read from an Internet Archive snapshot of 7 March 2025.
