Tobacco and nicotine age limits in New York (2026)
Last reviewed: 9 October 2026
In short: New York prohibits selling tobacco products, electronic cigarettes and liquid nicotine to anyone under 21, and federal law sets 21 for nicotine pouches. Smoking and vaping are banned in a long list of indoor areas, including public mass transportation. Flavoured nicotine vapor products, including menthol, may not be sold unless authorised by the FDA.

| E-cigarettes in indoor public placesTobacco and nicotine products | Yes. New York's Clean Indoor Air Act bans smoking and vaping (the use of an electronic cigarette) in the same indoor areas, including places of employment, bars, restaurants and public transport. [2] |
Notes
- The ban applies to a list of indoor areas (places of employment, bars, food service establishments, schools, hospitals, commercial establishments and others) rather than to every indoor public place.
- The list covers public means of mass transportation, including subways and, when occupied by passengers, buses, vans, taxicabs and limousines, and ticketing, boarding and waiting areas in terminals.
- Nicotine pouches are not named in the federal text. Under federal law any product containing nicotine from any source is a tobacco product that retailers may not sell to anyone under 21; the state's own statute was not checked for this rule.
