Notes

  • The same article bans supplying e-cigarettes and refill containers to people under 18. Retailers must display a notice of the ban and may ask for proof of age if in doubt.
  • Nicotine pouches may be marketed if they meet the requirements of Article 11hb (for example a nicotine content of at most 20 mg/g), but may not be supplied to people under 18, in vending machines or by self-service.
  • Smoking tobacco, including novel tobacco products, and using e-cigarettes is banned in workplaces, culture and leisure venues, restaurants and bars, and other indoor premises open to the public. Owners may set up designated smoking rooms in some venues, and one closed consumption room in a bar or restaurant with at least two rooms.
  • The ban covers public passenger transport, facilities serving travellers and public transport stops.
  • This rule concerns tobacco products. The same act also sets separate requirements for e-cigarettes and nicotine pouches, which were not compared here.
  • No rule on smoking in cars with children was found in the act read, and silence is not treated as a rule.
