Tobacco and nicotine age limits in Virginia (2026)
Last reviewed: 9 October 2026
In short: Virginia law prohibits selling or distributing tobacco products and hemp products intended for smoking to anyone younger than 21, and federal law sets 21 for e-cigarettes and nicotine pouches. The Virginia Indoor Clean Air Act bans smoking of lighted products in restaurants and listed places such as elevators and schools, not in all indoor public places, and does not cover e-cigarettes. Smoking in a car with a child under 15 carries a $100 civil penalty.

Notes
- The version effective 1 October 2026 defines "tobacco product" by reference to § 58.1-1021.01 (cigars, smokeless tobacco, pipe tobacco and loose leaf tobacco) and defines "cigarette" by reference to § 58.1-1000. The version in force until 30 September 2026 used a wider definition of "retail tobacco product".
- The Virginia Indoor Clean Air Act bans smoking in the listed places (such as elevators, public school buses, schools, hospital emergency rooms and polling rooms) and in restaurants, and requires no-smoking areas in some other facilities. It is not a general ban in all indoor public places.
- Section 15.2-2824(A) names elevators and public school buses but the sections read do not name buses, trains or other public transport open to the general public, so the position was not confirmed.
- Nicotine pouches are not named in the federal text. Under federal law any product containing nicotine from any source is a tobacco product that retailers may not sell to anyone under 21; the state's own statute was not checked for this rule.
- Local rules and the policies of individual businesses may still prohibit vaping.
- This is the federal retail rule. The state statute in force from 1 October 2026 (§ 18.2-371.2) refers to the tax definition of tobacco product, which does not expressly name e-cigarettes.
