Tobacco and nicotine age limits in Pennsylvania (2026)
Last reviewed: 9 October 2026
In short: Pennsylvania prohibits selling tobacco products, including e-cigarettes, to anyone under 21, in line with the federal minimum age. The Clean Indoor Air Act bans smoking in enclosed public places, including buses, trains, taxicabs and other mass-transportation vehicles, subject to exceptions; it covers only lighted products, not e-cigarettes.

Notes
- Act 112 of 2002 amended 18 Pa.C.S. 6305; in November 2019 it was amended again to raise the minimum age from 18 to 21. The federal minimum age of 21 for retailers (21 U.S.C. 387f(d)(5)) applies in every state.
- The Department of Health page states that retailers can no longer sell any tobacco product, including e-cigarettes, to anyone under 21. The federal definition of tobacco product also covers products containing nicotine from any source.
- Nicotine pouches are not named; as products containing nicotine they are tobacco products under federal law and cannot be sold by retailers to anyone under 21. The Pennsylvania statute text itself could not be read, so the federal rule is the source. FDA marketing authorisation is a separate matter and is not covered here.
- The Act bans smoking in public places, defined as enclosed areas serving as a workplace, commercial establishment or area where the public is invited or permitted. Many exceptions apply (for example tobacco shops, designated hotel rooms, cigar bars, drinking establishments, part of a casino gaming floor). Smoking is defined as carrying a lighted cigar, cigarette, pipe or other lighted smoking device, so e-cigarette use is not clearly covered by this text. The text read is the bill as reported by the conference committee; local rules may also apply.
- Covers vehicles used for mass transportation, including trains, subways, buses, chartered buses, planes, taxicabs and limousines, and train, subway and bus stations. The text read is the bill as reported by the conference committee.
- The Department of Health names Act 27 of 2008 as the current Clean Indoor Air Act. Local rules and the policies of individual businesses may still prohibit vaping.
