Notes

  • Since 1 January 2026 (Act 270/2025) the Addictive Substances Act allows people over 21 to possess cannabis for personal use without a permit. Above the limit it is an administrative offence; the Criminal Code applies above larger quantities. Under-21s have no exemption: possession up to 200 g at home or 50 g outside is an administrative offence.
  • The limits cover cannabis and other substances obtained from cannabis plants with more than 1 % THC. Possession for personal use above 200 g at home or 50 g outside it is a crime (Criminal Code section 285(2)).
  • Adults over 21 may grow, harvest and process up to 3 cannabis plants for personal use, in a property they own or hold under another legal relationship. More than 3 plants is an administrative offence for adults; growing more than 5 plants is a crime (Criminal Code section 285(1)).
  • Supplying cannabis without authorisation (making, importing, offering, selling) is a crime under Criminal Code section 283a. The text read provides no licensed retail or club scheme.
  • Rules on using cannabis in public places were not found in the sources read.
  • Medical cannabis is prescribed by a doctor as an individually prepared medicine; the doctor sets the type, THC and CBD content, dose and method of use.
  • The exemption is worded by age (over 21) and mentions no residency or nationality test.
  • No lawful retail channel exists in the sources read, so no purchase limit is stated.
  • The text covers other addictive substances (substances other than alcohol); for substances listed in an implementing regulation the limit value in blood is set there, and that regulation was not read.
