Cannabis law in Mexico (2026)

Last reviewed: 9 October 2026

In short: Mexico's General Health Law does not prosecute an adult consumer who holds up to 5 g of cannabis for strict personal consumption. The Supreme Court ordered authorisations for recreational self-consumption that exclude any trade or supply, and bar use before minors or non-consenting others in public. Medical cannabis medicines are regulated federally under the 2021 regulation and need a special prescription.

Notes

  • Article 478 of the Ley General de Salud bars prosecution of a drug-dependent person or consumer holding a narcotic at or below the Article 479 table quantity (cannabis: 5 g) for strict personal consumption. In an amparo of 11 May 2022 (AR 585/2020, three votes to two) the First Chamber of the Supreme Court held the words limiting this to the table quantity unconstitutional for cannabis as applied to the claimant, but left simple possession (Article 477) and the Article 479 table in place. Possession above 5 g for personal use is therefore assessed on the facts of the case.
  • In its 2021 general declaration of unconstitutionality (DGI 1/2018) the Supreme Court stated that the authorisation for recreational self-consumption never includes importing, trading, supplying or any other act of disposal or distribution of cannabis.
  • The Supreme Court (DGI 1/2018, 28 June 2021) directed that recreational self-consumption may not be exercised before minors or in public places where third parties have not consented, and that driving or operating dangerous machinery under the influence is not permitted.
  • The Reglamento of 12 January 2021 regulates production, research, manufacture and medical use of cannabis and its pharmacological derivatives, with COFEPRIS responsible for health regulation. Medicines are prescribed by registered professionals on special prescription pads; the regulation also covers international passengers, residents or not, carrying cannabis medicines with a prescription or a permit from their country.
