E-bikes and speed pedelecs in Portugal (2026)

Last reviewed: 30 October 2026

In short: An electric bicycle with a motor of up to 1.0 kW that cuts out at 25 km/h is treated as a bicycle under the Highway Code. Cycle tracks are to be used in preference where they exist. Age, helmet, licence and plate and insurance rules were not confirmed for these bikes.

Notes

  • Article 112(3) says 'for the purposes of this Code', so equating applies to the Code. Bikes above 1.0 kW, whose motor does not stop when pedalling stops, or which exceed 25 km/h are not covered by Article 112(2); Article 112(8) provides a fine and seizure for them.
  • Article 112(2) defines the 'velocípede com motor' with a maximum continuous power of 1.0 kW and an assist that fades with speed and stops at 25 km/h or when the rider stops pedalling.
  • The Highway Code articles read set no minimum age for riding a cycle. Silence is not treated as a rule.
  • Article 82(3) requires a helmet for moped, motorcycle, tricycle and quadricycle riders and does not mention cycles. An IMT report of June 2021 says the question of helmets for micromobility vehicles should still be studied and defined. Silence is not treated as a rule.
  • The licence rules read (Article 123 of the Highway Code and the licensing regulation) cover motor vehicle categories. They were not read for the electric bicycles of Article 112.
  • Articles 117 (registration) and 150 (insurance) apply to motor vehicles. Whether they apply to Article 112 electric bicycles was not confirmed in an official source.
  • Article 78(1) says vehicles of the kinds a lane is designed for should use it 'preferencialmente'. Article 78(3) refers to lanes for cycles.
  • Article 17(1) otherwise allows vehicles on verges or pavements only where access to buildings requires it, subject to local regulation.
