Notes

  • Applies to drivers of any vehicle, including cyclists, and covers handheld telephones and other handheld communication devices such as tablets and GPS units. Listed occupational exceptions exist in § 55 a stk. 2-5.
  • The prosecution guideline says hands-free use (headset, voice control, a holder fixed in the vehicle) is not covered by the ban, but may fall under the general duty of attention in § 3(1) depending on the circumstances.
  • Starting point set by the Director of Public Prosecutions for drivers of motor vehicles; the court decides the actual fine. The starting point is DKK 1,000 for cyclists and riders.
  • Denmark uses a clip system rather than penalty points: the offence gives one clip in the licence, counted on the same terms as other clip offences in § 125 stk. 2.
