Notes

  • A person stopped for an identity check must credibly prove their identity by showing an official identity document that contains the data needed (an ID card or another official document), or by making a digital document available. The police may also accept the statement of a known person present. Act LXVI of 1992 § 29(12) lists a valid passport and a card-format driving licence as accepted proof.
  • A citizen must apply for an ID card only if they have no other valid official identity document. Identity can also be proved with a valid passport or a card-format driving licence.
  • Act I of 2007 § 32(1) requires an EEA national or family member to show the document proving their right of residence when an authority entitled to check identity or lawful residence calls on them. A rule for short-stay visitors was not confirmed, and the Act on third-country nationals (Act II of 2007) was not usable in this round.
