E-bikes and speed pedelecs in Texas (2026)

Last reviewed: 9 October 2026

In short: Texas has three electric bicycle classes with a motor under 750 W and a top assisted speed of 20 mph or less (classes 1 and 2) or less than 28 mph (class 3). A person must be 15 to operate a class 3. TxDOT or a local authority may ban bicycles on sidewalks but may not ban electric bicycles where nonelectric bicycles are allowed, except on natural-surface paths.

Notes

  • Section 664.001 defines the electric bicycle by a motor of fewer than 750 W and a top assisted speed of 28 mph or less. Classes 1 and 2 have a top assisted speed of 20 mph or less. Class 3 has more than 20 but less than 28 mph.
  • Sections 551.104 and 551.107 contain no helmet duty for electric bicycles. Other chapters were not read.
  • Section 551.107(a) lists subtitles A, B and D and chapter 551A. The text read does not say what each covers, so a licence rule is not verified.
  • Both provisions are read in the enrolled text of H.B. 2188 (2019). The consolidated text of chapter 502 could not be read, so later amendments to section 502.143 are not excluded.
