Knives and pepper spray in Texas (2026)
Last reviewed: 9 October 2026
In short: Texas has no general ban on carrying knives; a knife with a blade over 5.5 inches is a 'location-restricted knife' that may not be taken into listed places such as schools, and under-18s may not carry one in public unless an exception applies. Switchblades are not prohibited weapons. Small chemical dispensers sold commercially for personal protection are excluded from the ban on chemical dispensing devices.
| Rule | What applies |
|---|---|
| Folding pocket knivesCarrying in public places | A knife with a blade of five and one-half inches or less is not a 'location-restricted knife'. Section 46.02 on unlawful carrying covers handguns, apart from subsection (a-4), which concerns only location-restricted knives (blade over 5.5 inches). Such knives are also barred in the places listed in section 46.03. [1] |
| Locking or one-handed knivesCarrying in public places | Texas law does not distinguish locking or one-handed knives. The only blade limit in chapter 46 is five and one-half inches for a 'location-restricted knife'. [1] |
| Fixed-blade knivesCarrying in public places | A knife with a blade over five and one-half inches is a 'location-restricted knife'. It may not be possessed in the places listed in section 46.03, such as school premises, and a person under 18 may not carry one away from their own premises or vehicle unless under the direct supervision of a parent or guardian (Class C misdemeanour). Chapter 46 has no other rule on carrying fixed blades. [1] |
| Pepper sprayCarrying in public places | A chemical dispensing device is a prohibited weapon. The definition excludes a small chemical dispenser sold commercially for personal protection. [1] |
| Exceptions and legitimate reasonsCarrying in public places | The restriction on weapons at schools does not apply when the weapon is carried under written regulations or written authorisation of the school or institution. [1] |
| Automatic (switchblade) knivesCarrying in public places | Switchblade and other automatic knives are not on the list of prohibited weapons in section 46.05, and the definition of 'knife' does not depend on how the blade opens. The general rules for location-restricted knives (blade over 5.5 inches) apply. [1] |
| Blade length limitsCarrying in public places | A knife with a blade over five and one-half inches is a 'location-restricted knife'. It may not be taken into the places listed in section 46.03, such as schools, and a person under 18 may not carry one away from their own premises or vehicle unless supervised by a parent or guardian (Class C misdemeanour). [1] |
| Pepper spray: size and age limitsCarrying in public places | A 'small chemical dispenser sold commercially for personal protection' is excluded from the prohibited 'chemical dispensing device'; the law gives no size in figures. Other chemical dispensing devices are prohibited weapons (third-degree felony), with a defence for trained security officers. [1] |
Notes
- Section 46.03 lists the places where a location-restricted knife is prohibited, including schools and postsecondary institutions; other places were not itemised here.
