Notes

  • The ban applies when the vehicle is in motion or part of traffic on a street or highway. A vehicle lawfully stopped in a location not designed for travel and not obstructing traffic is not in motion or part of traffic.
  • Calls and writing, sending or listening to messages are allowed solely in voice-activated or hands-free mode, without holding the device. This does not cover non-navigation video, video calls, live-streaming, gaming data or reading messages.
  • Subdivision 2(b) sets a fine of USD 275 for a second or subsequent violation. It states no amount for a first violation, and the general penalty provisions were not read.
  • Section 169.475 states no penalty points.
