Notes

  • Only marijuana bought from a licensed Ohio dispensary or grown at the consumer's primary residence under the home-grow rules is lawful to possess; marijuana obtained elsewhere, including from an out-of-state dispensary, is contraband. The rule comes from the Legislative Service Commission's final analysis of S.B. 56 (in force 20 March 2026); the text of R.C. 3796.221 itself was not available on codes.ohio.gov.
  • Not more than six plants per adult-use consumer and twelve per residence, grown at the consumer's primary residence. Home grow is not allowed at a child care home, a halfway house or similar facility, or rented premises whose lease prohibits it, and may not be done on behalf of another person. Exceeding the limits is illegal cultivation of marijuana.
  • Adult-use marijuana is sold by licensed dispensaries under Chapter 3796 of the Revised Code. A dispensary may not sell more than an adult-use consumer may lawfully possess in a day.
  • Smoking, combustion or vaporisation of adult-use or homegrown marijuana is prohibited anywhere other than privately owned real property used primarily for residential or agricultural purposes, and in any public place or place of employment. A violation is a minor misdemeanour. The final analysis notes that the general prohibition on public use was repealed; other forms of consumption are not covered by this rule.
  • Registered patients with a qualifying medical condition may obtain medical marijuana from licensed dispensaries under Chapter 3796. Smoking or combustion of medical marijuana is prohibited.
  • The statute defines an adult-use consumer as any individual at least 21 years of age and sets no residency requirement. Marijuana acquired outside the Ohio programme, including out of state, cannot lawfully be possessed.
