Notes

  • The Public Health Act 1997 bans selling, lending, giving or supplying any smoking product to or for the use of a child (under 18). It is a defence that proof of age was provided. Children are also banned from smoking and possessing smoking products (s 63).
  • Smoking product means any tobacco product or any personal vaporiser product, so the under-18 ban covers vapes. Pharmacy supply of therapeutic vapes is governed by separate medicines law, which was not read.
  • The TGA states that from 24 July 2026 there is no lawful pathway to buy or import nicotine pouches in Australia and that retail sale, including online, is illegal. This is Commonwealth therapeutic goods law and applies in every state and territory. The page was read as an Internet Archive snapshot of 17 July 2026 because the live page could not be reached.
  • Smoke-free areas also include designated areas, places near building entrances, playgrounds, public swimming pools and parts of outdoor sporting venues (s 67B).
  • The definition of smoke covers any smoke, fumes, vapour, mist or aerosol emitted from a smoking product, and smoking product includes personal vaporiser products.
  • Section 67H(2) applies to any vehicle with a child inside. Separately, s 67H(1) bans smoking in a vehicle used in the course of employment if another person is inside.
  • Commonwealth law separately bans flavouring additives and menthol in tobacco products Australia-wide (Public Health (Tobacco and Other Products) Regulations 2024, section 121).
