Notes

  • The Act defines a child as a person under 18 and bans sale of tobacco products to a child, including where the child buys for an adult.
  • Section 4A applies the Act to e-cigarettes and accessories as if they were tobacco products, so the sale ban for under-18s covers them. Pharmacy supply of therapeutic vapes is governed by separate medicines law, which was not read.
  • The TGA states that from 24 July 2026 there is no lawful pathway to buy or import nicotine pouches in Australia and that retail sale, including online, is illegal. This is Commonwealth therapeutic goods law and applies in every state and territory. The page was read as an Internet Archive snapshot of 17 July 2026 because the live page could not be reached.
  • Smoke-free areas also include outdoor public venues, food service areas, educational facilities, entrance areas and other places listed in section 7; domestic premises are generally excluded.
  • Public transport is a vehicle or vessel used by fare-paying passengers, including commercial passenger vehicles, trains and ferries. Public transport areas include bus stops, stations and terminals with shelter.
  • Section 4A(2) makes references to smoking of tobacco products include vaping or other use of e-cigarettes.
  • The offence applies to the person smoking if aged 16 or over. Section 4A(2) reads smoking as including vaping.
  • The ban is Commonwealth law and applies Australia-wide to tobacco products.
