Knives and pepper spray in West Virginia (2026)
Last reviewed: 9 October 2026
In short: West Virginia lets a person aged 18 or over who is not prohibited carry a concealed deadly weapon without a licence. Pocket knives with a blade of 3.5 inches or less, and pepper spray used solely for self-defence, are carved out of the definitions.
| Rule | What applies |
|---|---|
| Folding pocket knivesCarrying in public places | A pocket knife with a blade of three and one-half inches or less is not included in the definition of 'knife' unless knowingly used or intended to cause serious bodily injury or death. A person aged 18 or over who is not prohibited may carry a concealed deadly weapon without a licence. [1] |
| Locking or one-handed knivesCarrying in public places | The definition of 'knife' includes any switchblade knife or gravity knife, and a gravity knife is defined by release through gravity or centrifugal force and locking in place. A person aged 18 or over who is not prohibited may carry a concealed deadly weapon without a licence. [1] |
| Fixed-blade knivesCarrying in public places | The definition of 'knife' includes a dagger, dirk, poniard or stiletto with a blade over three and one-half inches. A hunting or fishing knife carried for hunting, fishing, sports or other recreational uses, or a tool or household knife, is excluded unless used or intended to cause serious injury or death. [1] |
| Pepper sprayCarrying in public places | 'Pepper spray' is defined as a temporarily disabling aerosol partly composed of capsicum oleoresin and intended for self-defence use. The term 'deadly weapon' does not include pepper spray when used by any person solely for self-defence purposes. [1] |
| Exceptions and legitimate reasonsCarrying in public places | A person may carry a concealed deadly weapon without a licence if they are at least 18 years old, a United States citizen or legal resident, and not prohibited from possessing a firearm under state law or 18 U.S.C. 922(g) or (n). [2] |
| Automatic (switchblade) knivesCarrying in public places | Switchblade and gravity knives fall within the definition of 'knife' and so are deadly weapons. A person aged 18 or over who is not prohibited from possessing firearms may carry a concealed deadly weapon without a licence. [1] |
| Blade length limitsCarrying in public places | A pocket knife with a blade of 3.5 inches or less is not a 'knife' under the weapons article unless used or intended to cause serious injury or death; daggers, dirks, poniards and stilettos over 3.5 inches are. For the school-related offences, knives with a blade of 3.5 inches or less also count as deadly weapons. [1] |
Notes
- The definition is wider for school-related provisions (sections 18A-5-1a and 61-7-11a), where a knife with a blade of 3.5 inches or less also counts as a deadly weapon.
