| Drinking in public placesBuying and drinking alcohol | A person under 21 who possesses any alcoholic beverage on any street or highway, in any public place or in any place open to the public commits a misdemeanour (fine of $250 or 24 to 32 hours of community service for a first violation; not more than $500 or 36 to 48 hours for a repeat). The statute does not apply to a person under 21 delivering alcohol on the instructions of a parent, responsible adult relative or designated adult, or in the course of employment, and has limited educational-tasting exceptions (B&P Code 25667, 25668). The section covers only under-21s; rules on drinking in public places for adults are mostly set by city and county ordinance. [3] |
